Judge set to give ruling on Tomatin name dispute this summer

A final Court of Session appearance by parties involved in a name dispute over a planned Highland retail development has been ruled as unnecessary.

Representatives of Tomatin Distillery and Tomatin Trading Company (TTC) had been scheduled to make one final appearance at a virtual hearing in front of presiding judge Lady Wolffe this past week.

The distillery, which dates back to 1897, is challenging TTC over its proposed use of the Tomatin name for its planned £12 million retail, hotel and hospitality development just off the A9 on the outskirts of the village.

Although the distillery has welcomed the proposal, it has raised an objection to the use of Tomatin, raising concerns that the new development would be taking advantage of the whisky-maker's reputation and could potentially cause confusion for visitors.

Lady Wolffe has decided that she is content with the evidence and submissions she has heard, and will now write her opinion.

Her ruling will be published later this summer.
