A grieving son took his brother's car without permission while drunk has been fined £940 and banned from driving for 18 months.

Father of two, 37 year old John Robb of Limekiln Wynd, Mossblown, Ayr had been drinking in the Old Bridge Inn in Aviemore on the night of March 8, last year.

But Inverness Sheriff Court heard he consumed too much and drove off in his brother's car which was parked outside.

Sheriff Sara Matheson was told that Robb also did not have a licence or insurance when he got behind the wheel at 10pm.

However staff at the premises were concerned about his actions, and informed police.

Fiscal depute Robert Weir told the court; "He was stopped at 10.13pm in the village and checks revealed he had no licence or insurance."

A subsequent breath test revealed he was almost four times the drink drive limit. The Sheriff heard his reading was 81mcgs, when the legal limit is 22mcgs.

He admitted four charges under the Road Traffic Act.

His defence solicitor, Graham Mann said: "This was a series of examples of bad judgment. His father had recently passed and he was drinking too much."
