A DRIVER who was pulled over by police was found to be nearly twice over the legal alcohol limit and had no insurance.

The incident happened at 11.20am on 5th November last year when Lee Ryan (24) of Madras Street, Inverness, was pulled over by officers between Drynie Avenue and Cauldeen Road in Inverness.

Depute Fiscal Safeena Rashid told Inverness Sheriff Court today that police noticed a strong smell of alcohol from Ryan’s breath and after being tested he was found to have 53 microgrammes of alcohol in 100 millilitres of breath which exceeds the legal limit of 35 microgrammes in 100 millilitres of breath.

Defence agent John McColl said Ryan, who is unemployed, had been drinking the night before and did not realise he was over the drink drive limit and that he did not have vehicle insurance because he had just bought the vehicle.

"There is no excuse to be put forward here," added Mr McColl.

Mr Ryan was charged with driving a motor vehicle on 5th November 2010 between Drynie Avenue and Cauldeen Road after consuming so much alcohol that the proportion in breath was 53 microgrammes of alcohol in 100 millilitres of breath which exceeded the prescribed limit of 35 microgrammes in 100 millilitres of breath.

He was also charged with driving without insurance and failing to appear at court on 1st March this year.

Upon sentencing, Sheriff Margaret Neilson said: "The courts take any drink driving matter very seriously."

Ryan was disqualified from holding or obtaining a drivers licence for 12 months and was fined £720.
