Brazilian woman failed to co-operate with police for roadside breath test in Aviemore





Police spotted a woman walking to her car in Aviemore last night (Sunday) and suspected she was under the influence of drink or drugs and decided to stop her vehicle.

But Inverness Sheriff Court was told that when officers eventually got her to stop after she initially ignored their attempts, they asked her to provide a roadside breath test.

Fiscal depute Rebecca Coakley told Sheriff Nigel Cooke that 33 year old Brazilian, Karine de Moura of Jane Street, Edinburgh refused to cooperate and was arrested.

De Moura was taken to Burnett Road Police Station in Inverness where she again refused to cooperate with a breath or blood test, saying: ‘I do not believe I gave any indication I was under the influence of alcohol. I think there was no reason for being stopped in the first place’, Ms Coakley told the court.

Defending, Patrick O'Dea said that his client admitted to twice refusing the tests after appearing today from custody.

He said: "She has no income and little savings and is being supported by friends. She intends to return to Brazil within the next nine months. She did cooperate with other procedures."

Sheriff Cooke ordered her to carry out 70 hours of unpaid work and banned her from driving for a year.
